This week the Supreme Court updated its docket in the matter of Monsanto v. Durnell to indicate the matter would be conferenced this Friday on January 16, 2026.to determine whether or not the Court will grant Certiorari to hear the case.

The central issue in Durnell is "federal preemption"—specifically, whether federal law prevents people from suing a company under state law for "failing to warn" about a risk if a federal agency (the EPA) has already approved the product's label without that warning.

Bayer currently faces over 60,000 pending lawsuits. A ruling in their favor could effectively dismiss the majority of these cases nationwide by blocking "failure to warn" claims.

The Supreme Court is scheduled to discuss this case in a private conference on January 16, 2026. We should know shortly after that date whether the Justices have officially agreed to hear the oral arguments later this year.
